Mediation is a form of alternative dispute resolution that allows the parties to  guide and formulate resolutions to their disputes outside of the courtroom. Parties may agree to enter into mediation as an alternative to litigation or they may be ordered by the Court, as part of the litigation process, to participate in mediation before the Court will hear their dispute.  Mediation is a confidential process that provides parties with an opportunity to work with a third-party to discuss their dispute in a constructive manner so that they may tailor agreements that meet the specific needs of their family and avoid the emotional and financial toll of litigation.
